Welcome to Fyrtle LLC (“Fyrtle,” “we,” “us,” or “our”). Fyrtle is a virtual fertility and reproductive health consultation company that provides educational resources, guidance, digital consultations, and licensed medical services, including the prescribing and management of certain medications such as GLP-1 receptor agonists, where clinically appropriate.

By accessing or using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use Fyrtle’s services.

1. About Fyrtle

Fyrtle LLC is a Delaware limited liability company. We provide online consultations, education, and care related to fertility, reproductive health, and metabolic wellness. Our consultations are conducted remotely via secure digital platforms and may include education, guidance, and prescription services delivered by licensed providers.

Fyrtle does not accept commissions or referral fees from third-party medical providers or pharmacies. Fyrtle maintains an affiliate agreement with Theralogix to make certain over-the-counter prenatal vitamins and supplements available to clients. These products:

Are considered suitable and safe during the preconception period; and

Are manufactured in accordance with U.S. Food and Drug Administration Good Manufacturing Practices (cGMP) standards.

This arrangement is offered solely as a potential convenience for Fyrtle clients. It does not constitute a medical endorsement, guarantee, or representation of superiority of Theralogix products compared with those of other manufacturers. Clients are free to use any prenatal vitamins or supplements they prefer.

2. Scope of Services

Fyrtle offers the following services:

• Virtual consultations with licensed providers.
• Education, guidance, and recommendations regarding fertility, reproductive health, and metabolic wellness.
• Evaluation, prescribing, and management of certain medications, including GLP-1 receptor agonists, when clinically appropriate and legally permitted.
• A supportive community of professionals providing guidance on health and fertility matters.

Licensure and Location of Services
Currently, Fyrtle’s prescribing and medication management services are limited to patients who are physically located in the State of Delaware at the time of their consultation. We are actively working to expand our ability to provide prescribing services in additional states. Once licensure and compliance requirements are met, patients located in other states may also be eligible to receive prescribing and medication management services.

‍Patient Location Attestation
For all prescribing and medication management services, including GLP-1 medications, patients must be physically located in the State of Delaware at the time of the consultation. As part of each telehealth visit, Fyrtle requires patients to attest to their physical location within Delaware. Misrepresentation of location may result in denial of services, termination of the provider-patient relationship, and potential reporting to regulatory authorities.

3. User Eligibility

By using our services, you represent and warrant that:

• You are at least 18 years of age.
• You provide accurate and truthful information in all forms, consultations, and communications.
• You understand that Fyrtle’s services, including prescribing, do not replace ongoing care with your primary healthcare provider.
• You agree to comply with all treatment instructions, disclose complete health information, and attend follow-up consultations as recommended.

4. Account Registration and Onboarding

To use our services, you must complete an onboarding process, including questionnaires about your health and fertility history. Depending on your care, additional medical information such as laboratory results may be required. All information you provide is confidential and will be handled in accordance with our Privacy Policy.

5. Booking and Payments

• Free Consultation: New users may be entitled to one complimentary consultation.
• Paid Consultations: All subsequent consultations require payment at booking.
• Medication Costs: Prescription medications, including GLP-1 receptor agonists, are dispensed by third-party pharmacies. Fyrtle is not responsible for pharmacy pricing, insurance coverage, or medication availability.
• Non-Refundable: Payments for consultations are final and non-refundable.

6. Privacy and Confidentiality

Your privacy is important to us. All information you provide, including health and medication history, is confidential and maintained on HIPAA-compliant systems. 7. Use of Services

You agree not to:

• Use Fyrtle’s services for any unlawful purpose.
• Provide false or misleading information.
• Misuse prescribed medications.
• Engage in harassment, offensive behavior, or disruption during consultations.

8. Medical Services and Limitations

Fyrtle’s services may include legitimate medical care provided by licensed healthcare professionals. However:

• Fyrtle does not provide emergency services. If you are experiencing a medical emergency, call 911 immediately.
  
• Fyrtle does not replace your primary care provider. You are responsible for maintaining general medical care outside of Fyrtle.
  
• No outcomes are guaranteed, including weight loss, fertility improvements, or pregnancy.

9. Third-Party Providers

Fyrtle may provide information about external providers, pharmacies, or resources. These are offered for your convenience only. We do not endorse, control, or guarantee any third-party services, and you are responsible for evaluating their suitability.

10. Disclaimers and Limitation of Liability

• Medication Risks: All medications, including GLP-1 receptor agonists, carry potential risks and side effects. Your Fyrtle provider will review these with you.

• Limitation of Liability: To the fullest extent permitted by law, Fyrtle is not responsible for damages, injuries, or losses related to your use of our services, including adverse effects from medications, actions based on consultations, or delays/errors from third-party pharmacies.
  
  

11. Termination of Services

Fyrtle may suspend or terminate your access to services if you:

• Violate these Terms.
• Fail to provide truthful health information.
• Misuse medications or fail to comply with medical instructions.
• Engage in unlawful, fraudulent, or harmful conduct.

You may discontinue services at any time, but remain responsible for all fees incurred.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Delaware. The arbitrator’s decision may be entered in any court of competent jurisdiction.

14. Changes to These Terms

Fyrtle reserves the right to update or modify these Terms at any time. Any updates will be posted with a revised “Last Updated” date. Continued use of the services after changes means you agree to the updated Terms.
